Please read these Terms of Service carefully before using Da3witi. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account or using Da3witi in any way, you confirm that you are at least 18 years old and agree to these Terms of Service and our Privacy Policy. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these terms.
2. Description of Service
Da3witi is a WhatsApp-based invitation management platform that allows you to create, send, and track event invitations. The service includes guest list management, RSVP tracking, QR code check-in, and automated messaging features. The service is provided by Dune Technical Services Company for Computer Technology WLL, registered in Kuwait.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to your account. We reserve the right to terminate accounts that violate these terms or that have been inactive for an extended period.
4. Payments and Refunds
Service fees are charged per event and are due before sending invitations. All prices are listed in Kuwaiti Dinars (KWD) and are inclusive of applicable taxes. Payments are processed securely through our payment provider. Refunds are not available once invitations have been sent. If technical issues on our end prevent delivery, we will work with you to resolve the issue or issue a credit.
5. User Content and Conduct
You retain ownership of content you upload (invitation cards, guest lists, event details). By uploading content, you grant us a limited license to use it solely for providing the service to you. You must not use Da3witi to send unsolicited messages, spam, or content that is illegal, offensive, or violates any third party's rights. You are solely responsible for obtaining consent from your guests to receive WhatsApp messages.
6. WhatsApp Compliance
Da3witi operates through the official WhatsApp Business API. You agree to comply with WhatsApp's Business Policy and Terms of Service. Sending messages to recipients who have not consented may result in suspension of your account and potential action by WhatsApp.
7. Limitation of Liability
Da3witi is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the specific event in question. We are not responsible for delays or failures caused by WhatsApp platform outages, network issues, or factors outside our control.
8. Modifications to Terms
We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the service after such notice constitutes your acceptance of the updated terms.
9. Governing Law
These terms are governed by the laws of the State of Kuwait. Any disputes shall be resolved in the competent courts of Kuwait.
